The “#MillesimaMoment Instagram Sweepstakes” is sponsored by Millesima USA (known as “Sponsor”). This sweepstakes is governed by these official rules (“Official Rules”). By participating in the sweepstakes, each entrant agrees to abide by these Official Rules, including all eligibility requirements and understands that the results of the sweepstakes, as determined by Sponsor and its agents, are final in all respects. The sweepstakes is subject to all federal, state and local laws and regulations and is void where prohibited by law. Official rules subject to change without notice.

Eligibility

Open to entrants residing in the United States during the dates of the sweepstakes, with the exception of states where regulations prohibit or restrict the organization of or participation in sweepstakes. All participants MUST be of legal age to consume alcohol in their location of origin. Sponsor reserves the right to verify the eligibility of each entrant. .

Submission Period

The sweepstakes will take place between February and December 2022, with a new winner chosen each month. Participants may choose to participate at any time during that period.

How to Enter

In order to enter the #MillesimaMoment Instagram Sweepstakes, each participant must first follow the @MillesimaUSA Instagram account, then publish a photo or video of a wine moment (featuring a wine purchased at Millesima) on their Instagram Feed (not Instagram Story) with a caption that includes a tag of the @MillesimaUSA account and the hashtag #MillesimaMoments embedded in the text. Posts published by any participant with an account open to the public will be visible to the Sponsor with no further action taken. Posts published by a participant with a private account will not be visible to the Sponsor until the Sponsor follows that account. Participants with private accounts must therefore contact the Sponsor by Direct Message to communicate their intention to participate in the sweepstakes. Upon receipt of the Direct Message, the Sponsor will follow the participant’s private account and have access to the posts published there.

Selection and Announcement of Winner

The submissions of each month will be entered into a lottery on the penultimate day of that month and one winner selected at random. The winner will be contacted and the winning submission shared on the MillesimaUSA Instagram feed and story on the final day of the month. The sponsor accepts no responsibility for posts not successfully published for whatever reason.

Prizes

Announcements and instructions for the prizes will be sent to the author of the winning post via Instagram Direct Message. Each participant is responsible for monitoring their Instagram account for prize notification and/or other communications related to this sweepstakes. If a potential prize winner cannot be reached by Sponsor within fifteen (15) days of announcing the winner, that potential prize winner shall forfeit their prize.

Upon the request of the Sponsor, the potential winner may be required to turn in additional documents proving his/her/their eligibility for a sweepstakes, including but not limited to: Affidavit of Eligibility, Release and Prize Acceptance Form and IRS W-9 form. If a potential winner fails to comply with these official rules, that potential winner will be disqualified. Prizes may not be awarded if an insufficient number of eligible entries are received.

Each month, the winner will receive a gift card with a value of $100. Values and prizes are subject to change. Additional terms and conditions may apply. ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE IS SOLELY THE RESPONSIBILITY OF THE WINNER.

While the Gift Card can be delivered to all major states, the Sponsor does not guarantee delivery of products purchased with the Gift Card to all US states.

Additional Limitations

Prizes will only be distributed to the author of the published post. Prizes are non-transferable. No substitution or cash equivalent of the prizes is permitted. The number of eligible entries received determines the odds of winning. Sponsor and its respective parent, affiliate and subsidiary companies, agents, and representatives are not responsible for any typographical or other errors in the offer or administration of the Sweepstakes, including, but not limited to, errors in any printing or posting or these Official Rules, the selection and announcement of any winner, or the distribution of any prize. Any attempt to damage the content or operation of this Sweepstakes is unlawful and subject to possible legal action by Sponsor. Sponsor reserves the right to terminate, suspend or amend the Sweepstakes, without notice, and for any reason, including, without limitation, if Sponsor determines that the Sweepstakes cannot be conducted as planned or should a virus, bug, tampering or unauthorized intervention, technical failure or other cause beyond Sponsor’s control corrupt the administration, security, fairness, integrity or proper play of the Sweepstakes. In the event that any tampering or unauthorized intervention occurs, Sponsor reserves the right to void suspect entries at issue. Sponsor and its respective parent, affiliate and subsidiary companies, agents, and representatives, and any telephone network or service providers, are not responsible for incorrect or inaccurate transcription of entry information, or for any human error, technical malfunction, lost or delayed data transmission, omission, interruption, deletion, line failure or malfunction of any telephone network, computer equipment or software, the inability to access any website or online service or any other error, human or otherwise.

Indemnification and Limitation of Liability

By entering the sweepstakes, each entrant agrees to indemnify, release and hold harmless the Sponsor and its parent, affiliate and subsidiary companies, administrator, advertising and promotional agencies, and all their respective officers, directors, employees, representatives and agents from any liability, damages, losses or injury resulting in whole or in part, directly or indirectly, from that entrant’s participation in the sweepstakes and the acceptance, use or misuse of any prize that may be awarded. Sponsor and its parent, affiliate and subsidiary companies do not make any warranties, express or implied, as to the condition, fitness or merchantability of the prize. Sponsor and its parents, subsidiaries, affiliates, advertising and promotional agencies, and all their respective officers, directors, employees, representatives and agents disclaim any liability for damage to any computer system resulting from access to or the download of information or materials connected with the sweepstakes.

This Sweepstakes is under no circumstance sponsored or administered, directly or indirectly, by Instagram, Facebook, YouTube, Dailymotion, Vimeo, or any broadcasting platforms, which have no involvement in the organization or promotion of the Sweepstakes.

Privacy Policy

By participating, each entrant grants Sponsor permission to use his/her/their name, likeness and/or comments for publicity purposes without payment of additional consideration, except where prohibited by law. Any personal information provided during the sweepstakes is for the exclusive use of the Sponsor. The information collected about each entrant is processed after collection of his/her/their consent, destined for Sponsor for the organization of the sweepstakes and the management of commercial relationship. Each entrant has a right of access, rectification, portability, erasure of these, or a limitation of treatment.
